On November 29, 2023, the Senate Subcommittee On Competition Policy, Antitrust, and Consumer Rights held a hearing, Examining the Competitive Impact of the Proposed Kroger-Albertsons Transaction.
Senator Josh Hawley (R-Missouri) asked the CEOs of Kroger and Albertson's questions regarding the effects of the proposed merger on religious freedom, ESG, and employment.
A few weeks after the hearing, FTC Chair Lina Khan published an op-ed titled, ESG Won’t Stop the FTC, which alleges that companies uses EGS policies as a justification for anticompetitive M&A.
